The litigation team of Bondoc și Asociatii obtained a new favorable solution in a specific dispute in the matter of administrative litigation over the annulment of a decision issued by the National Audiovisual Council (CNA) concerning comparative advertising issues in connection with the broadcasting of an audiovisual commercial.
The dispute covered both procedural issues relating to the significance of the obligation to justify and challenge CNA’S decisions, as well as an analysis in light of the applicable law, taking into consideration relevant regulatory acts (Audiovisual Law no. 504/2002 and Law no. 158/2008 on misleading advertising and comparative advertising) and the fulfilment of the legal requirements regarding legal comparative advertising versus potentially misleading comparative advertising in media advertising commercials.
The Bucharest Court of Appeal ordered the admission of the action therefore, the annulment of the National Audiovisual Council’s decision.
This recent success once again confirms the expertise of Bondoc si Asociatii in administrative litigation, including its ability to address niche areas, less common in court practice and where favorable solutions are quite infrequent.
