Our dispute resolution team at Eftimie & Asociații SCA, led by Cristian Eftimie, advised ERMEWA S.A., leading European freight wagons leasing company, in connection with a claim for material damages resulted from the breach of contractual obligations against the Romanian state-owned freight railway operator.

The Bucharest Tribunal admitted the claim in the first instance and ordered the Romanian freight railway operator to pay damages to ERMEWA amounting to 1.2 M EUR.

The amounts awarded by the court as material damages represent the equivalent of the sums paid by ERMEWA for the repairs carried out on the wagons rented to CFR Marfă due to inadequate maintenance by CFR Marfă during the lease contract concluded between the parties.
