The Law no. 37/2015 on classification of farms and agricultural holdings was published in Official Gazette of Romania, Part. 1, no. 172 of 12th March 2015.
The new law has the purpose to create a standard framework for implementing financing programs from the national budget and community funds.
The farms and agricultural holdings can have one or more owners and can be private or association property, and their legal form is in compliance with the provisions from the legislation in force.
Depending on the general type of agricultural activity, the holdings can be classified as follows:
A. Specialized holdings – crops
1) holdings specialized in field crops;
2) holdings specialized in horticulture;
3) holdings specialized in permanent crops.
B. Specialized holdings – animal products
1) holdings specialized in rearing herbivorous animals;
2) holdings specialized in rearing granivorous animals.
C. Mixed holdings
1) mixed crop holdings;
2) mixed holdings for rearing animals;
3) mixed holdings for crops and for rearing animals;
4) unclassified holdings.
Depending on the economic dimension, the farms and agricultural holdings are classified and defined as follows:
a) below 1,999 euro – subsistence farms that produce entirely for own consumption;
b) 2,000-7,999 euro – semi-subsistence farms that ensure their own consumption and a small part of the agricultural production that they commercialize;
c) 8,000-49,999 euro – small commercial farms that commercialize more than 50% of the agricultural production that they realize;
d) 50,000-999,999 euro – commercial farms/medium agricultural holdings which commercialize the entire agricultural production that they realize;
e) over 1,000.000 euro – commercial farms/large agricultural holdings that commercialize the entire agricultural production that they realize.
The subsistence farms provided at letter b) can process from their own production traditional products, in compliance with the legal provisions in force.
The farms and agricultural holdings provided at letters c)-e) represent forms of consolidation of the agricultural fields and may dispose also of own processing units, in compliance with the legal provisions in force.
